1. Introduction
Welcome to Two Birds Code. These Terms of Service (“Terms”) govern your access to and use of the websites, software, mobile applications, plugins, and services (collectively, the “Services”) provided by Two Birds Code LLC, a Texas limited liability company (“Two Birds Code,” “we,” “us,” or “our”), with its principal place of business at 2493 CR 427, Anna, Texas 75409, United States. EIN: 42-2856725.
By accessing or using the Services, purchasing any product, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Definitions
- “Customer,” “you,” or “your” means the individual or organization purchasing or using the Services.
- “Software” means our whitelabel community mobile applications, WordPress plugins, and any other software products we license or distribute.
- “SaaS Services” means our hosted, subscription-based community platform services.
- “Paddle” means Paddle.com Market Limited, our Merchant of Record, which processes payments and handles tax compliance on our behalf.
3. Eligibility and Account Registration
You must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Products and Services
Two Birds Code offers the following categories of products and services:
- Whitelabel Mobile Applications: Branded mobile applications for iOS and Android, licensed to organizations as their own community platform. Sold as one-time licenses with optional managed hosting subscriptions.
- WordPress Plugins: Premium plugins extending the Fluent Community platform, sold as annual licenses including updates and support.
- SaaS Subscriptions: Hosted community platform services billed on a recurring monthly or annual basis.
5. License Grant
Subject to your compliance with these Terms and payment of all applicable fees, Two Birds Code grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software and SaaS Services solely for your internal business or personal use as permitted by the product purchased.
You may not: (a) sublicense, resell, or distribute the Software except as expressly permitted by a written agreement with us; (b) reverse engineer, decompile, or disassemble the Software except to the extent permitted by applicable law; (c) remove or alter any proprietary notices; or (d) use the Services to develop a competing product.
6. Pricing, Payment, and Merchant of Record
All prices are listed on our website and are payable in U.S. Dollars unless otherwise stated. Payments are processed by Paddle.com Market Limited, which acts as the Merchant of Record for all transactions. Paddle is responsible for handling payment processing, fraud screening, sales tax, VAT, and other transaction-related compliance.
By making a purchase, you also agree to Paddle’s terms and policies, which are available at paddle.com. Receipts, invoices, and refund processing are handled through Paddle.
